Las Cruces Concrete Company is a licensed concrete contractor operating in Las Cruces, NM and surrounding communities. Services include but are not limited to concrete driveways, patios, sidewalks, foundations, slabs, retaining walls, pool decks, steps, garage floors, parking lots, footings, decorative and stamped concrete, foundation raising, and concrete cutting.
All work is performed by or under the direct supervision of licensed personnel. Scope, materials, and timelines for each project are defined in a written proposal provided to the customer prior to any work commencing. Services not described in the written proposal are not included and may require a separate agreement and additional cost.
On-site estimates provided by Las Cruces Concrete Company are complimentary and carry no obligation. Estimates are based on information available at the time of the site visit, including visible site conditions, customer-described scope, and current material costs. Written proposals are valid for 30 days from the date issued unless otherwise stated.
Prices in a written proposal may be subject to adjustment if site conditions discovered during work materially differ from those present at the time of the estimate, including but not limited to unanticipated caliche depth, buried utilities, unsuitable subgrade, or scope changes requested by the customer. Any such adjustments will be disclosed and agreed upon in writing before additional work proceeds.
Verbal estimates, ballpark figures, or ranges discussed in phone or email inquiries are not binding. A written, signed proposal is the only document that constitutes a price commitment.
Project start dates are estimated at the time of proposal acceptance and are subject to change due to weather conditions, material availability, permit processing times, or prior project delays. Las Cruces Concrete Company will communicate schedule changes promptly.
Cancellation of a signed project agreement by the customer after materials have been ordered or permits have been filed may result in a cancellation fee to cover documented material restocking charges and permit filing costs. The specific amount will be outlined in the project agreement.
Las Cruces Concrete Company reserves the right to postpone or reschedule work in cases of severe weather, including active monsoon-season rainfall, extreme heat conditions that would compromise concrete quality, or other conditions outside our control.
Payment terms are specified in the written project agreement. Typical terms require a deposit prior to work commencement, with the balance due upon substantial completion of the project unless otherwise agreed in writing.
Invoices not paid within the timeframe specified in the project agreement may be subject to a late payment fee. Las Cruces Concrete Company reserves the right to suspend work on any project where payment is overdue.
Accepted payment methods are specified in the project agreement. Las Cruces Concrete Company does not accept payment arrangements not documented in the signed agreement.
Las Cruces Concrete Company warrants that all work will be performed in a workmanlike manner using materials that meet or exceed the specifications in the written proposal. Any warranty period and specific warranty terms will be stated in the project agreement.
Concrete is a natural material subject to cracking, settlement, and surface variation. Hairline cracking caused by normal shrinkage is inherent to concrete and does not constitute a defect. Warranty claims must be submitted in writing and will be assessed on a case-by-case basis.
Las Cruces Concrete Company makes no warranty, express or implied, regarding work not covered by a signed project agreement, work performed on existing structures not installed by Las Cruces Concrete Company, or damage caused by events outside our control, including soil movement, flooding, tree root intrusion, or misuse of the completed surface.
To the fullest extent permitted by applicable law, Las Cruces Concrete Company's total liability to a customer for any claim arising from a project shall not exceed the total amount paid by the customer under the applicable project agreement.
Las Cruces Concrete Company is not liable for indirect, incidental, consequential, or punitive damages, including loss of use, loss of revenue, or costs arising from delays, regardless of whether such damages were foreseeable or Las Cruces Concrete Company was advised of the possibility of such damages.
Where a City of Las Cruces building permit or other governmental approval is required for the project scope, Las Cruces Concrete Company will obtain such permits and file applications under its valid New Mexico Construction Industries Division license. Permit fees are the responsibility of the customer and will be included in the project proposal where applicable. Las Cruces Concrete Companyis not responsible for delays caused by the permitting authority's processing timelines.
In the event of a dispute arising from services provided by Las Cruces Concrete Company, the parties agree to first attempt resolution through good-faith written notice and negotiation. Written notice of a dispute must be provided to Las Cruces Concrete Company within 30 days of the event giving rise to the claim.
If good-faith negotiation fails to resolve the dispute within 30 days of written notice, the parties agree to submit the dispute to binding arbitration in Doña Ana County, New Mexico, under the rules of the American Arbitration Association. Each party bears its own costs unless the arbitrator determines otherwise.
These Terms and Conditions and any project agreements entered into with Las Cruces Concrete Companyare governed by the laws of the State of New Mexico, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Doña Ana County, New Mexico.
